One of the most widespread immigration myths is this: "If I marry a U.S. citizen, I automatically get a green card." This is not true — and believing it can lead to dangerous inaction. Marriage to a U.S. citizen makes you eligible to apply for a green card, but it does not grant one automatically. There is a formal application process, and it takes time.

 

What Marriage to a U.S. Citizen Actually Does

 

Marriage to a U.S. citizen makes you an "immediate relative" for immigration purposes. This means you are exempt from annual visa caps, which significantly reduces wait times compared to other immigration categories. But you still must go through the full application process to be granted permanent residency.

 

The Process You Still Need to Complete

 

Even after marriage to a U.S. citizen, you must:

 

1. Have your spouse file Form I-130 (Petition for Alien Relative) with USCIS.

2. Complete and submit Form I-485 (Adjustment of Status) if in the U.S., or go through consular processing if abroad.

3. Attend a biometrics appointment.

4. Attend a green card interview together with your spouse.

5. Receive an approval decision from USCIS.

 

Only after completing these steps will you receive a green card.

 

How Long Does It Take?

 

Processing times vary, but in general, spouses of U.S. citizens can expect the process to take anywhere from 12 to 24 months or more, depending on the USCIS office, your case complexity, and whether any additional evidence is requested.

 

What Happens If You Do Nothing?

 

If you marry a U.S. citizen and take no action, your immigration status does not change. If you were undocumented before the marriage, you remain undocumented after it. This is why timely action is critical.
