I'm on Disability — Can I Still Sponsor My Spouse for a Green Card?

If you receive disability benefits and want to sponsor your spouse for a green card, you may be wondering whether your income situation disqualifies you. The honest answer: it depends on the type of disability income you receive and whether it meets the minimum income threshold. But even if it doesn't, you have options.

 

Does Disability Income Count on the I-864?

 

Yes — and this surprises many people. Social Security Disability Insurance (SSDI) is considered earned income and counts toward the income requirement on Form I-864. If your SSDI income equals or exceeds 125% of the federal poverty guideline for your household size, you may be able to sponsor your spouse entirely on your own.

 

What About SSI?

 

Supplemental Security Income (SSI) is different. SSI is a needs-based program, and its use can raise "public charge" concerns in certain immigration contexts. Additionally, SSI payments are often lower and may not meet the income threshold. If you receive SSI and are concerned about sponsoring your spouse, speak with an immigration attorney before proceeding.

 

The Joint Sponsor Solution

 

If your disability income alone does not meet the requirement, a joint sponsor can make your case possible. A joint sponsor is a U.S. citizen or green card holder who agrees to take on financial responsibility alongside you. They must meet the income requirements on their own. This does not mean they have to support your spouse directly — only that they accept legal responsibility if your spouse ever needs public assistance.
