If you overstayed your U.S. visa and are now married to a U.S. citizen, you are not alone — and you may still have a path to permanent residency. What Does "Overstaying" Mean?
A visa overstay occurs when you remain in the United States beyond your authorized period of admission — the date listed on your I-94 record. Even one day beyond that date places you in "unlawful presence," which can have serious immigration consequences. However, the impact depends on how long you overstayed and whether you have left the country since.
Overstay + Spouse Is a U.S. Citizen = Good News
If you are married to a U.S. citizen and currently living in the United States, you may be able to file for adjustment of status (Form I-485) without leaving the country, even if you overstayed your visa. This is one of the most important distinctions in U.S. immigration law. Being an "immediate relative" of a U.S. citizen offers significant protection in these situations.
Important Warnings
If you leave the United States with an unlawful presence of 180 days or more, you may trigger a 3-year or 10-year bar from returning. This is why it is critical to consult an immigration attorney before taking any action — especially before traveling internationally.
