My Spouse Doesn't Work — Can I Still Sponsor Them for a Green Card?

Your immigrant spouse doesn't need a job to get a green card, but you as the petitioner do need to meet income requirements. Learn about Form I-864, joint sponsors, and how LaGrone Law can help.
One of the most common questions we hear is: "If my spouse doesn't work, can I still get a green card?" The good news is that your immigrant spouse's employment status does not affect their eligibility. What matters is your financial ability — as the petitioning spouse — to support them above the federal poverty guidelines.
The Affidavit of Support: Form I-864
Every marriage-based green card application requires the U.S. citizen or LPR sponsor to file Form I-864, Affidavit of Support. This form is a legally binding contract in which you promise the
U.S. government that your spouse will not become a "public charge" — meaning they will not rely on most government benefits.
What Income Do You Need?
The sponsoring spouse must demonstrate income of at least 125% of the federal poverty guideline for your household size. For example, if you and your spouse make up a two-person household, you need to meet the income threshold for two people. The exact amount changes each year, so consulting with an immigration attorney for current figures is strongly recommended.
What If You Don't Meet the Income Requirement?
If you fall short of the income threshold, you have options:
- Count household assets: Savings, stocks, property, and other assets can sometimes be used to supplement income.
- Use a joint sponsor: A financially qualified person — a family member, close friend, or even an employer — can co-sign the I-864 and take on legal responsibility for supporting your spouse.
The Joint Sponsor Option
A joint sponsor must be a U.S. citizen or LPR, at least 18 years old, and domiciled in the United States. They do not have to be related to you. This is a powerful and commonly used option for families where the petitioning spouse is a stay-at-home parent, student, or retiree.
